Mesquite Gaming, LLC (“Mesquite Gaming,” “us,” “we,” or “our”) values your patronage and respects your privacy. This Privacy Policy (“Policy”) describes our information collection, use, protection, and sharing practices.

We operate physical gaming and hospitality locations (collectively, “Mesquite Gaming Properties”), as well as websites and online platforms (collectively, “Mesquite Gaming Web Sites”). Together, Mesquite Gaming Properties and Mesquite Gaming Web Sites are referred to as the “Services.”

In this Policy, “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household.

Information We Collect

We collect information from a variety of sources and in a variety of ways, including without limitation, the following:

  • Contact Information. When you visit Mesquite Gaming Web Sites or physical properties, you might provide us with contact and other Personal Information such as your name, date of birth, postal address, e-mail address, and telephone number.
  • Purchase and Transaction Information. When you visit Mesquite Gaming Web Sites or physical properties, we might collect information about your purchases, reservations, and gaming activity.
  • Payment Information. When you make a purchase or engage in other transactions, you might provide us with your credit or debit card number and financial account number.
  • Government Identifiers. When you make a purchase or engage in other transactions, you may provide us with your driver’s license number, state identification card number, Social Security number, passport number or other naturalization number.
  • Device and Browser Information. When you visit Mesquite Gaming Web Sites, we might collect information about the type of device and browser you are using, the unique number assigned to your server or Internet connection, your geographic location, and your interactions with the Mesquite Gaming Web Sites. We use “cookies,” tracking pixels, and similar technologies to help us recognize and serve you better, to deliver and measure the effectiveness of advertising campaigns, and to understand how you interact with our Services. If you participate in a contest, sweepstakes, or giveaway that we conduct through social media platforms, we may collect your username, name, and information about the prize awarded.
  • Other Information. We may obtain information about you from third parties, such as marketing partners, data brokers, public databases, and companies that provide demographic or interest-based data.

How We Use the Information We Collect

  • Marketing Purposes. We may use the information we collect for our own marketing purposes such as notifying you of special promotions, offers, and events via e-mail, telephone, text message, push notifications, and other means.
  • Non-Marketing Purposes. We may use the information we collect for non-marketing purposes such as (1) validating your identity; (2) recording gaming-related activity (in jurisdictions where gaming is permitted); (3) conducting statistical or demographic analysis; (4) processing, fulfilling, and tracking reservations, purchases, or other transactions; (5) complying with legal and regulatory requirements; (6) customizing your experience at Mesquite Gaming Web Sites; (7) protecting and defending Mesquite Gaming and its affiliates against legal actions or claims; (8) preventing fraud; (9) debt collection; and (10) satisfying contractual obligations (collectively “Non-Marketing Purposes”).

When it is possible to do so, we may link Personal Information (such as your name or e-mail address) with non-personal information (such as the unique identifier associated with your computer or mobile device). We may also link Personal Information with other generally or publicly available information to help us identify your preferences or interests. The information we collect may also be merged with information available from other sources such as (1) companies that match e-mail addresses with postal addresses and other information; (2) credit card verification and credit services; and (3) other subsidiaries, resorts, casinos, or properties that are owned, operated, or affiliated with Mesquite Gaming (collectively “Mesquite Gaming Subsidiaries”).

How to Opt Out of Marketing Messages

Although you may opt-out of the use and sharing of Personal Information for marketing purposes, we may still use and share information we collect for Non-Marketing Purposes.

Cookies and Tracking Technologies

We and our third-party partners use cookies, tracking pixels, and similar technologies on Mesquite Gaming Web Sites to collect information about your browsing and purchasing activity. These technologies serve several purposes, including:

  • Recognizing you when you return to our Services and remembering your preferences;
  • Delivering and measuring the effectiveness of advertising campaigns, including retargeting you with advertisements after you have visited our Services;

Security

We employ a number of administrative, technical, and physical safeguards designed to protect the Personal Information we collect. The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Services.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted to our Services. Any transmission of Personal Information is at your own risk.

Data Retention

We may retain your Personal Information for a period of time consistent with the original purpose of collection outlined in this Privacy Policy. We determine the appropriate retention period for data on the basis of the amount, nature, and sensitivity of your Personal Information processed, the potential risk of harm from unauthorized use or disclosure of your Personal Information, and whether we can achieve the purposes of the processing through other means, as well as on the basis of applicable legal requirements, such as applicable statutes of limitation.

Third Party Sites

Mesquite Gaming Web Sites may contain links to other websites, mobile applications, and other online services operated by third parties. These links are not an endorsement of, or representation that we are affiliated with, any third party. In addition, our content may be included on web pages or in mobile applications or online services that are not associated with us. We do not control third-party websites, mobile applications, or online services, and we are not responsible for their actions. Other websites, mobile applications, and services follow different rules regarding the collection, use, and sharing of your Personal Information. We encourage you to read the privacy policies of the other websites, mobile applications, and online services you use.

Age Restrictions

Certain of our gaming areas and activities are intended for persons 21 or older. If you are under 21, you may not access or attempt to access any areas or participate in any activities that are restricted to persons 21 or older. The age-21 restriction applies to gaming and certain hospitality activities as required by applicable law; it is separate from the CCPA’s provisions regarding the Personal Information of consumers under 16 years of age, which are addressed in the Notice to California Consumers section below. We do not knowingly collect or allow the collection of Personal Information from persons under 21 in connection with age-restricted gaming or hospitality activities. If you are the parent or guardian of a person under 21 and believe that the person has provided us with Personal Information, you may contact us at privacy@mesquitegaming.com and request that it be deleted from our records.

Notice to California Consumers

If you are a California resident, the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, the “CCPA”), provides you with certain rights regarding your Personal Information. This section describes your CCPA rights and explains how to exercise those rights. For purposes of this section, “Personal Information” has the meaning given in the CCPA (which may differ from the general definition above) and does not include information that is publicly available, deidentified, or aggregated.

Collection and Disclosure of Personal Information

In the preceding twelve (12) months, we have collected the following categories of Personal Information:

  1. identifiers (e.g., name, date of birth, postal address, e-mail address, telephone number, IP address, and unique device identifiers);
  2. Personal Information categories listed in Cal. Civ. Code § 1798.80(e) (e.g., name, address, telephone number, Social Security number, driver’s license number, state identification card number, passport number, and financial account information);
  3. commercial information (e.g., records of purchases, reservations, gaming activity, and other transactions at Mesquite Gaming Properties or Mesquite Gaming Web Sites);
  4. internet or other electronic network activity information (e.g., information about the type of device and browser you are using, the unique number assigned to your server or Internet connection, your interactions with Mesquite Gaming Web Sites, cookie data, tracking pixel data, and conversion tracking data);
  5. geolocation data (e.g., approximate geographic location inferred from your IP address or device information);
  6. sensitive Personal Information (e.g., Social Security number, driver’s license number, state identification card number, passport number, naturalization number, credit or debit card number, and financial account number); and
  7. inferences drawn from the above categories to create a profile reflecting your preferences and interests.

The categories of third parties to whom we disclose Personal Information for a business purpose include: service providers and other third parties under contract (who are contractually required to protect your information and restrict its use to the purposes for which it was provided); Mesquite Gaming Subsidiaries; business partners (for marketing purposes); credit card verification and credit services; and government authorities or law enforcement agencies (where required by applicable law or legal process).

Sources of Personal Information

We collect Personal Information from the following categories of sources: (a) directly from you (e.g., when you visit Mesquite Gaming Properties or Mesquite Gaming Web Sites and provide contact, purchase, or transaction information); (b) indirectly from you (e.g., through your use of Mesquite Gaming Web Sites and our automated data collection technologies, including cookies); (c) from social media platforms (e.g., when you use integrated social media features on Mesquite Gaming Web Sites or mobile applications); (d) from third parties (e.g., companies that match e-mail addresses with postal addresses and other information); and (e) from credit card verification and credit services.

Business and Commercial Purposes for Collecting Personal Information

We collect and use Personal Information for the business and commercial purposes described in this Policy, including: (a) Marketing Purposes, such as notifying you of special promotions, offers, and events via e-mail, telephone, text message, push notifications, and other means; (b) Non-Marketing Purposes, including validating your identity, recording gaming-related activity (in jurisdictions where gaming is permitted), conducting statistical or demographic analysis, processing and fulfilling reservations, purchases, or other transactions, complying with legal and regulatory requirements, customizing your experience at Mesquite Gaming Web Sites, protecting and defending Mesquite Gaming and its affiliates against legal actions or claims, preventing fraud, debt collection, and satisfying contractual obligations; and (c) linking Personal Information with non-personal information to help identify your preferences or interests, and merging information with data available from other sources.

Sale and Sharing of Personal Information

We do not “sell” your Personal Information as that term is defined under the CCPA. However, our use of third-party advertising technologies, including tracking pixels and cookies provided by Google Ads, Simpli.fi, and Meta, may constitute “sharing” of your Personal Information for cross-context behavioral advertising purposes as defined under the CCPA. The categories of Personal Information that may be shared for these purposes include identifiers (such as IP address and unique device identifiers) and internet or other electronic network activity information (such as browsing activity, purchasing activity, and interactions with Mesquite Gaming Web Sites). These categories of Personal Information may be shared with the following third parties: Google (through Google Ads and Google Analytics), Simpli.fi, and Meta. We do not have actual knowledge that we sell or share the Personal Information of consumers under 16 years of age. You may opt out of the sharing of your Personal Information for cross-context behavioral advertising purposes by e-mailing us at privacy@mesquitegaming.com with the subject line “CCPA Data Opt Out Right.” You may also use opt-out preference signals such as the Global Privacy Control (GPC) to automatically opt out of the sharing of your Personal Information when you visit Mesquite Gaming Web Sites.

Your CCPA Rights

Subject to certain exceptions, as a California resident you have the following rights:

  • Right to Know. You have the right to request that we disclose to you: the categories and specific pieces of Personal Information we have collected about you; the categories of sources from which your Personal Information was collected; the business or commercial purposes for collecting or selling your Personal Information; and the categories of third parties with whom we share your Personal Information.
  • Right to Delete. You have the right to request that we delete Personal Information that we have collected from you, subject to certain exceptions provided by law.
  • Right to Correct. You have the right to request that we correct inaccurate Personal Information that we maintain about you.
  • Right to Opt-Out of Sale or Sharing. You have the right to opt out of the sale or sharing of your Personal Information. As described above, we may share your Personal Information for cross-context behavioral advertising purposes. To opt out, you may e-mail us at privacy@mesquitegaming.com with the subject line “CCPA Data Opt Out Right” or use an opt-out preference signal such as the Global Privacy Control (GPC).
  • Right to Limit Use of Sensitive Personal Information. To the extent we collect sensitive Personal Information (as defined under the CCPA), including the sensitive Personal Information described in this Policy, you have the right to limit our use and disclosure of such information to purposes permitted by the CCPA.
  • Right to Data Portability. To the extent required by the CCPA, you have the right to request that we transfer your Personal Information to another entity, in a structured, commonly used, machine-readable format, to the extent technically feasible.
  • Right to Non-Discrimination. We will not discriminate against you for exercising any of your CCPA rights. We will not deny you goods or services, charge you different prices or rates, provide you a different level or quality of goods or services, or suggest that you may receive a different price or rate or different level or quality of goods or services because you exercised your CCPA rights.

Exercising Your CCPA Rights

Only you, or a person you have authorized to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child. We will verify your identity before fulfilling your request by matching information you provide with information we have on file. We will respond to your request within forty-five (45) days of receiving it. If we require more time (up to an additional forty-five (45) days), we will inform you of the reason and the extension period in writing. You may make a verifiable consumer request for access or data portability no more than twice within a twelve (12) month period.

Authorized Agents

You may designate an authorized agent to submit a request on your behalf. To do so, you must provide the authorized agent with written permission to act on your behalf, and we may require you to verify your own identity directly with us and confirm that you provided the authorized agent permission to submit the request.

Notice of Financial Incentives

We may offer discounts, marketing incentives, rewards, or other benefits to you if you sign up for promotional campaigns, loyalty programs, player rewards programs, or other similar programs. When you sign up for such a program, we typically ask you to provide your name and contact information (such as your e-mail address, postal address, and/or telephone number). Because our programs involve the collection of Personal Information as well as the offering of various benefits, our programs may be interpreted as providing a “financial incentive” under California law. You can opt into these programs by creating an account and enrolling in the loyalty program through our Services. Participation is voluntary, and you may withdraw from the program at any time by following the instructions provided through the program. Please note that we may not be able to provide you with the benefits of the program if you request that we delete any of your Personal Information that is essential to providing you with the benefits of that program. The value of your Personal Information is reasonably related to the value of the offer or discount provided to you as part of these programs.

Automated Decision-Making Technologies

We use AI and automated technologies as part of our Services, including to create personalized advertising campaigns. We do not use automated decision-making technologies to make significant decisions about California residents that would trigger access, opt-out, or appeal rights under the CCPA.
